Terms and Conditions of Use of the FiestaPic Application

Astramunt S.A.S de C.V. (hereinafter, “Astramunt”) makes available to users the mobile application and associated services called FiestaPic (the “App” or the “Service”). Access to or use of the App implies full acceptance of these Terms and Conditions (the “Terms”). If you do not agree, you must refrain from using the App.

1) Definitions

• App: the FiestaPic technology platform, accessible as a mobile application and/or web application, including its features, interfaces, updates, and associated services.
• User: a person who creates an account and/or uses the App.
• Host: a User who creates and manages an event in the App.
• Guest: a User who joins an event by scanning a QR code or link (URL) shared by the Host.
• Event: a space within the App in which the Host and Guests share photos and videos.
• Content: photos, videos and any material that Users upload to an Event.
• Event Package: a set of FiestaPic entitlements acquired by the User to activate or use one or more Service features for an Event, such as a digital album, a Digital Invitation, an Event Expansion, credits, or other equivalent functionality shown within the App.
• Event Expansion: additional capacity or functionality that may be added to an Event through a compatible package, credit, or equivalent entitlement shown within the App.
• Digital Invitation: a digital invitation experience associated with an Event, created and managed by the Host within FiestaPic, including designs, expert-designed templates, guest lists, tables, schedules, locations, and related invitation details. The Host may prepare a Digital Invitation before activating or sending it, and the App will show when a package, add-on, credit, or equivalent entitlement is required.

2) Account, registration and authentication

• Using the App requires registration via email or sign-in with Google or Apple. The App retains only the token and user ID provided by those third parties to authenticate access; it does not store passwords for those services.
• The User is responsible for keeping their credentials confidential and for any activity performed from their account.
• The User declares that they have the legal capacity to contract under applicable law.

3) Creating and using events

• Guests can join and browse events free of charge. To enable Content uploads, the Event must be activated with an Event Package, Event Expansion, credit, or equivalent entitlement from the Host or from Guests authorized by the Host.
• An Event can be created in advance and remain not activated until the Host decides to activate it.
• The Host controls who may join, post, and/or download Content and may remove Guests at any time.

4) Event activation, term, and expiration

• Once activated, the Event will have a reference maximum term (for example, 30 days) that may vary without prior notice. The applicable term will be shown within the App.
• At the end of the term, the Event changes to “expired”: no new Content can be uploaded and downloads are disabled.
• Content from an expired Event will be deleted from Astramunt’s servers within a reference maximum period of 30 days from expiration, a period that may be modified without prior notice. It is the Host’s exclusive responsibility to download the Content before the Event expires.
• An Event that has not been activated may be deleted by Astramunt after 2 years from its creation (a period subject to change without prior notice). Any package, expansion, credit, or equivalent entitlement assigned or reserved to that Event will be subject to the Service rules in effect and will not create a right to partial recovery, refund, or transfer, except where required by applicable law or by the applicable app-store or payment-provider policy.

5) Event size limits

• Events will have a maximum size defined by FiestaPic’s services and by the package, expansion, credit, or equivalent entitlement assigned to the Event. It is not possible to exceed the applicable cap, except through a compatible Event Expansion or entitlement shown within the App when available.
• When the total usage of shared files reaches the applicable event limit, no further photos or videos may be added. Deleting posts by Users does not free up or reduce the recorded total usage.

6) Event packages and allocation rules

• Users may purchase or use Event Packages, Event Expansions, Digital Invitation add-ons, credits, or other equivalent entitlements shown within the App to activate or expand an Event and its related features.
• When assigning or activating a package, expansion, credit, or equivalent entitlement to one’s own Event, the entitlement is debited, allocated, and considered consumed for that Event as a whole according to the App’s current rules. The package is not divided, tracked, or returned to the User as a visible storage amount or partial balance, and no unused portion, remaining capacity, remainder, or equivalent fraction is recoverable, refundable, or transferable to another Event, even if the Event is ended, canceled, deleted, suspended, or expires.
• Digital Invitations package rule: a Host may create an Event, prepare the Digital Invitation, use available expert-designed templates, add Guests, assign tables, and configure invitation details before payment or activation when the App allows it. The first send, first distribution, activation, or use of certain Digital Invitation features may require assigning a compatible package, add-on, credit, or equivalent entitlement shown within the App. Once the Digital Invitation is activated or first sent, the assigned package, add-on, credit, or equivalent entitlement is considered definitively consumed/assigned and is not recoverable or reimbursable to the account, even if the Event is later canceled, ended, deleted, suspended, or expires. No unused portion, remaining capacity, remainder, or equivalent fraction of the assigned entitlement is recoverable, refundable, or transferable.
• Digital Invitation activation and edit lock: when a Host performs the first send or first distribution of a Digital Invitation from within the App, that Digital Invitation becomes active. From that point on, pursuant to Astramunt policy, no adjustments or changes will be allowed to the invitation name/title (for example: “Laura & Miguel Wedding”) or the event date.
• An Event Expansion, package, credit, or equivalent entitlement contributed by a Guest to an Event they do not own is considered definitively assigned to that Event and is not recoverable by the Guest under any circumstance.
• It is forbidden to recover package benefits, expansions, credits, or equivalent entitlements already spent and/or transfer them to another Event that is not owned by the User who assigned them.
• Package and entitlement expiration: if a purchased package, expansion, credit, promotional entitlement, or equivalent unit remains unused in the account for 2 years from the date of purchase or acquisition, such entitlement will expire and will no longer be available (a period subject to change without prior notice). Expired entitlements are not refundable.
• Continuity and migration from the prior model: before these Terms became effective, FiestaPic could offer balances or packages measured in MB/GB. The terms applicable to that model already provided that Astramunt could change package naming, stop offering MB/GB packages, or migrate to another model for acquiring or using the Service, while crediting the User with an equivalent or greater amount of any unexpired and unused balance. By accessing or continuing to use the App under those terms, the User accepted that adaptation. This update preserves that continuity and provides that valid balances or entitlements from the prior model will be recognized or compensated in favor of the User within the new package system. This includes valid GB already purchased, valid GB reflected in the User’s account, and valid FiestaPic cards, gift cards, promotional codes, or other codes intended to add GB to the account, provided they have not been used, expired, canceled due to fraud, chargeback, misuse, or other valid operational or legal reason.
• Future changes to packages or models: Astramunt may, at any time, modify package names, benefits, capacities, measurement units, add-ons, expansions, credits, or consumption models for acquiring or using the Service. If Astramunt converts valid paid account entitlements that have not yet been assigned, activated, consumed, expired, or canceled, the User will receive an equivalent or greater economic or functional value within the App, which may be granted as packages, expansions, add-ons, credits, or other equivalent FiestaPic rights. Any such conversion will not be considered a cash refund, except where required by applicable law or by the applicable app-store or payment-provider policy.

7) Purchases, charges, and invoicing

• The prices of Event Packages, Event Expansions, Digital Invitation add-ons, credits, or equivalent entitlements may vary according to included benefits, capacity, package type, promotions, or operational adjustments.
• All purchases are final and no refunds are accepted. For clarity, any “recognition,” “compensation,” or “conversion” referenced in these Terms refers only to the migration or conversion of valid account-level entitlements that have not yet been assigned, activated, consumed, expired, or canceled (not to partial recovery from an Event and not to a cash refund), and such migration or conversion is subject to the specific conditions and limitations set forth herein, except where required by applicable law or by the applicable app-store or payment-provider policy.
• The User is responsible for taxes, bank fees, or third-party charges that may apply.
• Astramunt may cancel or suspend purchases when there are signs of fraud, chargeback, or misuse of the payment method.

8) Uploading Content and moderation policy

It is strictly forbidden to publish Content that:

• Is pornographic, obscene, or sexually explicit.
• Incites or depicts illegal or criminal activities.
• Is disturbing, violent, or contrary to good morals.
• Is irrelevant or unrelated to the Event to which it is shared.

Astramunt may remove Content that breaches these Terms and block or suspend repeat-offender accounts. The User declares and warrants that they hold all necessary rights and authorizations (including image rights) to the Content they publish and that it does not infringe third-party rights.

9) Access to and privacy of Content

• Event Content will be visible to its Host and to Guests who join via the Event’s QR code or link (URL).
• While the Event has not expired, Users may delete posts they personally uploaded and report inappropriate Content.
• The Host may revoke any Guest’s access at any time. In such case, that Guest’s posts will be deleted from the Event and will no longer be accessible.
• If a Guest leaves an Event, their posts are not deleted automatically; they must delete them before leaving.
• The Host may configure which Guests are authorized to download Content. By default, even when the Host grants download permission, Guests may only download individual items and not the entirety of the Event.
• Astramunt may set a maximum limit on the number of Guests with download permission per Event. The Host may consult the current limit in the App, which may be modified without prior notice.

10) Downloads and the download link

• The Host (or someone the Host authorizes within the App) may download Content one by one.
• Alternatively, when the Host manually ends the Event from within the App, the system will enable a button to generate a download link that allows all files (photos and videos) from the Event to be obtained.
• The download link will have an expiration date and a maximum number of uses defined by Astramunt and visible upon accessing that link; both parameters may change without prior notice.
• It is forbidden to share the download link. Only the Host may use the link to download the Content of their Event.
• Although FiestaPic may apply access controls and download restrictions, Astramunt cannot guarantee that Guests or third parties will never download, copy, or retain images, videos, or posts, particularly in web environments where resource handling depends on browser and device behavior.
• The User acknowledges and accepts that it is not technically possible to fully prevent screenshots or screen recordings on mobile devices or web browsers.

11) Account deletion

• The User may request deletion of their account from the App’s settings section.
• Upon request, the account is deactivated immediately; the User’s active Events may be deleted and the Content cannot be recovered.
• Full deletion of the account will be processed within a reference maximum period of 30 days (a period subject to change without prior notice).
• If the User had unused packages, expansions, credits, promotional entitlements, or equivalent account rights at the time of requesting account deletion, such entitlements cannot be recovered or refunded by any means, except where required by applicable law.

12) Host responsibility

• The Host is responsible for sharing the Event’s QR code or link only with people they wish to grant access to.
• Astramunt is not responsible for misuse by third parties of codes or links shared by the Host.
• The Host may delete their Event at any time. Doing so will result in the permanent loss of all photos and videos, and Guests will no longer be able to access the Event or their posts.
• Digital Invitations: the Host is solely responsible for (i) the content they upload, enter, or configure in the Digital Invitation (including text, images, audio, songs, music, designs, links, locations, schedules, names, and any other material), (ii) having all necessary rights and permissions for such content (including image rights, copyright, and other intellectual property rights), and (iii) sending or distributing the Digital Invitation to their Guests and managing the recipient list. Astramunt does not verify recipients and is not responsible for claims, infringements, or violations of copyright, intellectual property, or third-party rights arising from content incorporated by the Host into the Digital Invitation. The Host acknowledges that once they perform the first send of the Digital Invitation, they cannot modify the invitation name/title or event date.

13) Service availability and loss of information

• Like any IT service, the App may experience temporary interruptions due to maintenance, technical failures, or causes beyond Astramunt’s control. Reasonable efforts will be made to restore service as quickly as possible.
• If, due to extraordinary causes (e.g., technological failures, natural disasters), User information (Events and Content) is lost, the User accepts that such information may not be recoverable. In such cases, there will be no refunds or compensation; Astramunt may, at its discretion, offer credits or goodwill alternatives.
• Astramunt assumes no responsibility for unauthorized access, cyberattacks, intrusions, theft, and/or unlawful disclosure of Content (including photos and videos) caused by third parties (“hackers”) or other events beyond its control.

14) Intellectual property and license over Content

• The User retains the rights that correspond to them over their Content.
• By uploading Content, the User grants Astramunt a non-exclusive, worldwide, royalty-free license for the time necessary to host, reproduce, process, and display such Content in order to operate the App (including backups, optimization, and moderation).
• The User warrants that they have all necessary authorizations, licenses, and consents (including image rights, copyright, and other intellectual property rights) to publish their Content (for example: images, videos, audio, music, or songs) and that such Content does not infringe third-party rights. Astramunt is not responsible for infringements or claims related to User-provided Content.
• Anonymized invitation themes: when a Host saves a customized Digital Invitation, authorized FiestaPic administrators may privately review its latest saved presentation for catalog curation. Astramunt may create a frozen reusable theme from an explicit allowlist of visual settings, including colors, typography, section order, button and timeline styling, hero position, dress-code icons, and sticker placements. The reusable theme will not include the Host's or Guests' names, text, dates, photos, audio, locations, personal links, invitation or RSVP records, visibility settings, or account identity. Publishing a theme does not change the Host's invitation, and later edits by the Host do not change the frozen theme. If a Host uses a personal sticker in a published theme, the Host grants Astramunt a non-exclusive, worldwide, royalty-free license to reproduce and offer that sticker as an independent reusable catalog asset, subject to moderation and applicable law.

15) Personal data and privacy

The processing of personal data is governed by Astramunt’s Privacy Notice, available within the App or through FiestaPic’s official channels. The User must review it to learn about purposes and contact methods.

Depending on your preferences and applicable permissions, we use information about your use of FiestaPic, your device and purchases to improve the experience and understand which advertising is helpful. To do this, we may share this information with Google and Meta and use cookies or similar tools. You can turn off analytics and advertising measurement at any time in the privacy settings on our website.

16) Prohibited conduct

• Attempting to compromise the security or integrity of the App, accounts, or servers.
• Interfering with the operation of the Service (e.g., unauthorized automated mass uploads).
• Using the App for unlawful, defamatory, fraudulent purposes or in ways that infringe third-party rights.
• Copying, reproducing, scraping, reverse engineering, reselling, sublicensing, “pirating”, or commercially exploiting the App, the Service, Digital Invitations, templates, designs, workflows, or any portion thereof, except to the extent expressly permitted in writing by Astramunt.

17) Suspension and cancellation

Astramunt may suspend or cancel accounts or Events that violate these Terms, in cases of payment fraud, chargebacks, abuse of the service, or pursuant to requests from competent authorities.

18) Limitation of liability

Astramunt will not be liable for indirect, incidental, special, punitive, or consequential damages, nor for loss of data, revenue, or reputation, arising from the use or inability to use the App.

19) Amendments to the Terms

Astramunt may amend these Terms at any time. Amendments will take effect upon publication within the App or on official channels. Continued use of the App after publication constitutes acceptance of the new Terms.
